Job Summary

The Commercial Title Insurance Examiner is responsible for performing comprehensive title examinations, analyzing the chain of title, and identifying issues that may cloud or impair title, especially in relation to foreclosure actions.

Key Responsibilities:

  • Title Examination: Conduct title examinations for a wide range of title orders, primarily focusing on residential purchase transactions. Review and analyze the chain of title to identify potential issues that could affect title integrity.

  • Foreclosure Review: Review the full foreclosure process to ensure compliance with state and federal requirements. Assess the foreclosure action to verify that it was conducted properly and confirm that the foreclosure deed will clear appropriate liens.

  • Liens and Title Issues: Identify and evaluate liens or claims that may cloud the title. Determine which liens will be cleared or divested upon recordation of the Foreclosure Deed, ensuring that the property title is clear for closing.

  • Commitment Preparation: Add necessary requirements and exceptions to title commitments based on title issues that need to be resolved before closing. This includes addressing title defects and ensuring all relevant matters are accounted for.

  • Record Abstracting & Analysis: Abstract and analyze various records, such as mortgages, liens, judgments, easements, vital statistics, plats, and maps, to verify ownership, legal restrictions, and the accuracy of the legal description of the property.

  • Issue Resolution: Resolve issues such as missing or incomplete information, inaccuracies, or contradictory data found in title documentation, ensuring the title is clear and accurate before closing.

  • Title Commitment Documentation: Prepare initial title commitment documentation, applying procedural guidelines to create accurate and compliant title commitments.

  • Communication & Client Relations: Communicate with office staff and clients to address title issues, discuss coverage or defects that may impact the closing, and provide guidance to resolve outstanding matters.

  • Other Duties: Perform other responsibilities as assigned by the manager, providing support and expertise in various aspects of title examination and insurance processes.

Qualifications & Education Requirements:

  • Education: Bachelor’s degree preferred.
  • Experience: Minimum of 5 years of experience in the title insurance industry, with national or regional experience being highly preferred.
  • Experience utilizing Title Express or similar title software preferred.
  • Strong understanding of title examination, foreclosure processes, and title insurance requirements.
  • Ability to analyze and interpret complex legal documents and property records.
  • Ability to make sound risk decisions and manage title issues effectively.
  • Proficiency with Green Folders and other title-related systems is a plus.
